3. Eligibility

To use the Platform, you must:

Have the legal capacity to enter into binding contracts.
Comply with all applicable local, state, national, and international laws.

4. Registration

In order to access the services provided on the Platform, you must create an account. 5. Subscription Plans

The Platform offers subscription-based services on a monthly or annual basis. Subscription fees are clearly communicated before purchase, and payment is required in advance for each billing cycle. 6. Subscription and Payment Terms

Payment Information: To process payments for your subscription, you must provide valid payment details, such as credit card or PayPal information. You authorize Dhanarthi to charge the applicable subscription fees, including any taxes, to your designated payment method.
Automatic Renewal: Your subscription will automatically renew at the end of each billing cycle, either monthly or annually, depending on your selected plan. You will be charged the applicable renewal fee unless you cancel the renewal before the renewal date.
Billing Failures: If automatic billing fails for any reason, Dhanarthi will issue an electronic invoice with instructions to manually complete the payment. Failure to resolve billing issues may lead to suspension or termination of your access to the Platform.

7. Free Trial

Dhanarthi may, at its discretion, offer a free trial for a limited period. You may be required to provide billing information for the free trial. Dhanarthi reserves the right to modify or cancel any free trial offer at any time, with or without notice.

8. Subscription Fee Changes

Dhanarthi reserves the right to modify the subscription fees at any time. Any changes to the subscription fee will take effect at the end of your current billing cycle. By continuing to use the Platform after a price change takes effect, you agree to pay the new fee.

9. Refund and Cancellation Policies (Subscription-Based Services)

No Refund Policy: All purchases are final and non-refundable. Once a subscription is processed, it cannot be refunded, exchanged, or credited. You are responsible for reviewing your subscription details and ensuring that the service meets your needs before making a purchase.
Cancellation: You may cancel your subscription at any time. To cancel, visit your "Account Settings" page and follow the provided instructions. Upon cancellation, you will continue to have access to the Platform until the end of your current billing cycle. After that, access to the service will be terminated.
Automatic Renewal: Subscriptions automatically renew at the end of each billing cycle. You may cancel the renewal at any time before the renewal date to avoid further charges. If you fail to cancel before the renewal date, you will be billed for the next cycle.
Billing Cycle: Subscriptions are billed on a recurring basis (monthly or annually), depending on your chosen plan. All subscription fees are due in advance and will be charged on the first day of each billing cycle.
Refunds: All payments made for subscriptions are non-refundable. Dhanarthi does not offer refunds for partial months, unused portions of the service, or any cancellations during an active subscription period.
Exceptions: Although the general policy is non-refundable, Dhanarthi may, at its sole discretion, offer exceptions on a case-by-case basis. Any such exceptions will be clearly communicated in writing.

10. User Obligations and Restrictions

By using the Platform, you agree to:

Provide accurate information during registration and maintain up-to-date details.
Not use the Platform for any illegal or fraudulent purposes.
Not impersonate any individual or entity or misrepresent your affiliation with any person or organization.
Not access the Platform or use any automated means (such as bots or data scraping) to collect information or interfere with its operations.

You agree to indemnify Dhanarthi from any loss, damages, or legal expenses resulting from any violation of these Terms.

11. Content and Intellectual Property

All content on the Platform, including market reports, stock recommendations, analysis, articles, and multimedia content (the “Content”), is owned by Dhanarthi or its licensors and is protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access and use the Content for personal, non-commercial purposes only. Unauthorized use of the Content is prohibited.

12. Indemnity

You agree to indemnify, defend, and hold harmless Dhanarthi, its affiliates, directors, officers, employees, and agents from any claims, liabilities, damages, costs, and expenses (including legal fees) arising from your use of the Platform, your violation of these Terms, or your infringement of any intellectual property rights.

13. Limitation of Liability

To the fullest extent permitted by law, Dhanarthi and its affiliates are not liable for any indirect, incidental, consequential, or punitive damages arising out of your use or inability to use the Platform, including any loss of data or profits. Dhanarthi’s total liability to you for any claim related to these Terms shall not exceed the amount you paid for the subscription in the past three months.

14. Dispute Resolution

Any disputes arising out of or in connection with these Terms will be resolved through arbitration in accordance with Indian law. Mediation will be attempted before arbitration, and if unresolved, the dispute will proceed to binding arbitration. The seat of arbitration shall be Surat, Gujarat.

15. Privacy Policy

By using the Platform, you consent to the collection, storage, and use of your personal data as described in our Privacy Policy. Please review the Privacy Policy to understand how we process your information.

16. Force Majeure

Dhanarthi will not be liable for failure to perform any obligations due to causes beyond its reasonable control, including but not limited to natural disasters, acts of God, pandemics, or internet outages.

17. Governing Law

These Terms are governed by and construed in accordance with the laws of India. All disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in Surat, Gujarat.
